What is the EB-5 Programand why is it the most secure way to achieve permananent residency in the United States?

Established in 1990, the EB-5 Immigrant Investor Program initiative permits foreign individuals to make a qualifying investment in either a new or established US commercial enterprise, thereby creating a minimum of 10 jobs and enabling them to acquire a Green Card.

Through this program, EB-5 Investors and their families attain permanent residency, granting them the privilege to reside and work anywhere in the United States. Notably, a single EB-5 investment facilitates the procurement of Green Cards for the primary applicant, their spouse, and any unmarried children below the age of 21.

*Targeted Employment Area or “TEA” is the qualifying term used for the lower $800,000 investment amount. Rural designated projects receive priority processing from USCIS which results in significantly lower wait times. Please note that these timing estimates are just that, estimates. Do Research

Conducting thorough due diligence is crucial. Investors should meticulously review the project’s business plans, market analysis, and legal documentation. In addition to the due diligence steps mentioned above, it is essential that investors thoroughly review the track record and performance of the developer and regional center involved in the project.

Factors such as project track record, location, industry prospects, and investment structure should be carefully considered during this stage. Christian Tyler Properties (“CTP”) offers rural designated projects eligible for faster processing times and approval times in as little as 3 months.

Invest

The process generally requires the investor to transfer the required investment amount to an escrow account or to the project’s designated bank account. It is important to ensure compliance with the EB-5 program’s regulations and the project’s specific investment requirements. Source of funds review will be completed before the funds are wired to ensure compliance.

File Your I-526E Petition

The next step – in conjunction with an immigration attorney – involves filing an I-526E petition with the U.S. Citizenship and Immigration Services (USCIS). This petition demonstrates that the investor has made the necessary investment and that the project will create the required number of jobs.

Apply for Green Card
Upon I-526E Approval

Upon approval of the I-526E petition, investors and their eligible immediate family members can apply for a conditional green card, which grants them the right to live and work in the United States. During this time, they can enjoy the benefits and opportunities available to permanent residents. For example, investors and their eligible family members can explore a wide range of educational institutions, seek employment without additional work visas, and access health services. Additionally, the program offers potential tax advantages and opens the door to a number of business and investment opportunities in the US market.

Transition to Permanent Green Card

After two years of holding the conditional green card, investors can apply for the removal of conditions (Form I-829). Once the conditions are removed, investors receive a permanent green card, providing them and their family members with long-term residency and additional benefits.

Apply for US Citizenship
and Passport (Optional)

After holding a permanent green card for a specified period of time, typically five years, EB-5 investors and their eligible family members have the option to apply for US citizenship. Upon becoming US citizens, investors are granted all the rights and privileges that come with citizenship, such as voting in elections and owning a US passport. It is important to note that applying for US citizenship is an optional step in the EB-5 process. Investors may choose to maintain their permanent resident status indefinitely if they do not wish to pursue citizenship.

WHAT IS PRIORITY PROCESSING?

EB-5 Investors are now enjoying 3-8 month I-526E processing times in Rural TEA Designated Projects! Currently, approved rural investors have realized an average 5-month I-526E processing time with some reported cases as low as 3-months.

 

On 15th March 2022, the Biden administration passed the EB-5 Reform & Integrity Act (RIA) of 2022. The law requested USCIS, the government agency that oversees lawful immigration, to reduce the processing time for I-526E Petitions under what is termed “Priority Processing” for Rural TEA Designated Projects. Rural areas are defined as towns with less than 20,000 people located in a county that does not have a metropolitan statistical area. Non-rural EB-5 investments will continue to be processed under normal processing, there have not been any I-526E Approvals post-RIA so it is unknown how long non-rural petitions will take to be processed.

WHAT ARE THE CAPITAL REQUIREMENTS FOR AN EB-5 INVESTMENT?

Proper documentation of source of funds is critical, and funds required for the investment may include, but are not limited to:

  1. Accumulation of salary
  2. Earnings from business ownership
  3. Proceeds from sale/mortgage of real estate property
  4. Gift
  5. Inheritance
  6. Loans - you can utilize them and it is best practice loans be secured by an asset. Funds can be sourced from anywhere in the world if they legally belong to the investor.
HOW AND WHEN DO I GET MY MONEY BACK?

The Project has multiple ways to secure the EB-5 Investors and their Capital Contribution to the Project. Each Project serves as an EB-5 lending entity that has provided financing in the form of a secured loan to Development of the Project . The investment is structured through three interconnected agreements: the Project Loan Agreement, the Promissory Note, and the Deed of Trust.

 

Once the Investor’s EB-5 process has run its course, CTP has multiple options to monetize the Project and return the loaned

capital back to the EB-5 Investors according to the terms of the Project Loan Agreement. Those options include, but are not limited to:

  1. Refinancing through the Government Sponsored Enterprises (“GSE’s”) of HUD, FHA, FNMAE, and Freddie Mac and the Section 232 program.
  2. Selling the Project
  3. Repayment via Operational Revenue
  4. Refinancing through a traditional commercial loan
WHAT IS EB-5 JOB CREATION REQUIREMENT?

An EB-5 investor must invest the required amount of capital in a new commercial enterprise that will create full-time positions for at least 10 qualifying employees.

 

For a new commercial enterprise located within a Regional Center, the new commercial enterprise can directly or indirectly create the full-time positions.

 

Direct jobs establish an employer-employee relationship between the new commercial enterprise and the persons it employs.

Indirect jobs are held outside of the new commercial enterprise but are created because of the new commercial enterprise.

HOW ARE JOB CREATION METHODOLOGIES USED TO SHOW JOB CREATION IN THE REGIONAL CENTER PROGRAM?

Rather than count 10 hired employees, the USCIS allows Regional Centers to use multiple economic impact formulas to connect money spent on a project with the number of jobs created. This means if the money is spent on the project as specified the jobs are created and are permanent.

CAN I MOVE TO THE UNITED STATES IMMEDIATELY AFTER FILING MY EB-5 PETITION?

The US Concurrent Filing Process is available for some people who are already living in the United States or have a pre-existing visa for staying in the country. Concurrent filing is the process of submitting multiple applications for immigration benefits simultaneously. In the context of EB-5 immigration, it refers to filing an I-526E petition and an I-485 application for adjustment of status at the same time. This process allows the applicant to remain in the U.S. while their EB-5 petition is being processed.
