CTP’s Take on The IIUSA Lawsuit

At Christian Tyler Properties our main priority is the protection and success of our investor families.

IIUSA Lawsuit Overview

On March 29, 2024, Invest in the USA (IIUSA) filed a lawsuit against USCIS over the sustainment period policy introduced in October 2023. This policy requires investors’ capital to remain “at risk” for two years to meet EB-5 requirements. IIUSA seeks to overturn the policy and implement a five-year sustainment period instead.

At Christian Tyler Properties (CTP), we want to address this head-on. We were not involved in the lawsuit or any decision-making process behind it. Our concern is that this action could create increased uncertainty for investors relying on the current two-year rule. Litigation and policy changes like this underscore the importance of protecting our investors through efficient, well-structured projects

CTP’s Stance on the IIUSA Lawsuit

At Christian Tyler Properties, we are clear in our position:

  • No involvement in the lawsuit: CTP is not affiliated with IIUSA’s leadership or the decision to pursue this lawsuit. We were not consulted, nor are we represented on any IIUSA executive committees or their board, as can be seen by searching on the IIUSA website that is available to the public.
  • We believe that investors need clear, consistent policies, not ongoing regulatory battles that create confusion. Uncertainty in the EB-5 process can be detrimental to families who are relying on predictable timelines to secure their future in the U.S.
  • While the sustainment period is a critical factor for project planning, CTP prioritizes efficiency and transparency in our project timelines. Our projects, particularly Rural Targeted Employment Area (TEA) developments, are structured to meet both immigration and financial goals within reasonable timeframes.

CTP’s Advantage: Designed for Timely Success

Unlike some larger regional centers that promote long-term projects we focus on Rural Targeted Employment Area (TEA) projects, that minimize the need for investors to redeploy funds after the sustainment period. Our strategy ensures a clear and reliable path from investment to development and successful operation.

The Bigger Picture: Investor Awareness Matters

While the lawsuit claims to support the EB-5 program, it appears to reflect the priorities of legacy regional centers whose interests may not always align with those of their investors. Investors are becoming more aware of the risks associated with prolonged timelines and are looking for reliable options that emphasize timely project completion and positive outcomes. At CTP, our projects are built around efficiency, compliance, and investor success, always keeping your needs at the forefront.

Moving Forward: CTP is Here to Help

While industry challenges will come and go, our priority remains unchanged—ensuring that our investors can navigate the EB-5 process with confidence and clarity. If you have concerns about the recent lawsuit or how it might impact your plans, we encourage you to reach out to us.

No matter what changes occur in the industry, our investor families will always come first. Your success—both in achieving your immigration goals and securing your financial future—is at the heart of every decision we make. We are committed to offering well-structured projects designed to minimize risk, and ensuring you have the information you need to make confident, informed choices
